Wee Care Nanny was Awarded a Preliminary Injunction vs. WeeCare.co

AN IMPORTANT MESSAGE FROM THE WEE CARE NANNY TEAM ABOUT THE PRELIMINARY INJUNCTION AWARDED  VS. WEECARE.CO:

On April 27, 2023, the U.S. District Court for the Southern District of New York found that Plaintiff Wee Care Nanny Agency has shown that there is a likelihood of confusion caused by Defendant WeeCare, Inc.’s use of the WeeCare mark with Plaintiff’s valid and incontestable registered trademark “Wee Care Nanny”, and granted our motion for a preliminary injunction enjoining Defendant WeeCare, Inc. from using the name WeeCare in connection with services for placing nannies and babysitters for childcare and educators for children in the home. The Federal Order from the U.S. District Court for the Southern District of New York can be viewed here Order Awarding Preliminary Injunction vs. WeeCare.co.

To be clear, Wee Care Nanny Agency is NOT affiliated with the online platform WeeCare.co. Wee Care Nanny takes seriously the right to protect all our clients (nannies, sitters, educators, and families alike) from marketplace confusion caused by another company’s improper use of our trademark name, and to protect the goodwill and stellar reputation Wee Care Nanny has built upon for over 20 years.

Therefore, if you mistakenly signed up with the WeeCare.co online platform, and intended to sign up with Wee Care Nanny Agency, please contact us at 203-359-8405 or marc@weecarenanny.com. We are happy to help and appreciate all your support!

The Nanny Hiring Process

We know the hiring process can be incredibly stressful for nannies and hiring families alike. Understandably, in the 20+ years of doing this, we have seen a lot of uneasiness, confusion and misinformation regarding current market salaries, vacation time, sick days, raises, responsibilities etc.   Wee Care is always happy to provide honest and helpful guidance to nannies and families so both parties can make a well-informed decision.  If you have any questions, please call us at 203-359-8410 or 212-364-5142.

2022 Holiday Bonus Guide for your Nanny, Housekeeper, or Sitter

Naturally, we get some version of the question below often this time of year so we wanted to offer some guidance.

“We adore Evelyn. she has been a godsend. Do you have guidelines for what families typically give as a Christmas gift?”

A full-time Nanny can usually expect a holiday bonus of one to two week’s compensation – two week’s pay depending upon her length of service.  If your nanny has been with you for several years, the bonus may exceed two weeks, if feasible. Additionally, if the nanny has been with the family less than a year, half of her weekly salary is standard, or one full day of pay for each month she has worked for you. If the nanny is just starting, a $100 to $200 gift card sets a nice tone.  A hand-written note of thanks expressing your appreciation and referencing a yearly highlight of the caregiver/child relationship is an additional way to show your genuine gratitude.

Some families will include an extra little something coming from the children like a homemade card, cookies or her favorite confection which surrounds the monetary gift with genuine warmth and appreciation from the child.

For the part-time regular babysitter that provides care several times each month, a gift equal to one night’s pay is the norm. Many families choose to provide a $100-$150 gift card to her favorite shop, cafe, nail salon etc.

Housekeeper/Cleaner, one or two week’s pay, depending upon her length of service and a small gift like a bottle of wine, fine chocolate or Mani-Pedi gift card.

The holiday bonus signifies your family’s appreciation for her performance and dedication to your children’s care, development, and the vital role your nanny plays with your family. A family should also include an annual review (ask us about our evaluation template) which helps nannies and families understand where change may be needed and to recognize areas where the nanny’s performance has exceeded expectations.

Obviously, this is a general guideline of industry norms in the NY metropolitan region. Some families give considerably more or less depending on overall job performance, length of employment, particular circumstances, and family budget.

Wee Care Nanny wishes you and your loved ones a wonderful and joyous holiday season!

Do you use a Payment App like Venmo, PayPal or Zelle to Pay your Nanny or Housekeeper?

Good article from Cnet explaining the confusion over the new IRS reporting law for payments over $600 made through payment apps like Venmo, PayPal, Zelle etc. Tax advisors recommend employers of nannies, housekeepers, companions and other domestics paying salaries through a payment app should do so through a separate business account so the payments  are clear and easier to tie into their nanny’s or housekeeper’s W-2. You should consult your own tax or legal advisor to avoid any missteps.

“Going forward, third-party payment companies will issue you a 1099-K tax form each year if you earn $600 or more annually in income for goods or services. This tax form might include taxable and nontaxable transactions, particularly if the account is for both business and personal use.

The IRS will also receive a copy of the tax form and won’t be relying purely on self-reporting. “The IRS will be able to cross-reference both our report and yours,” PayPal noted in a November 2021 press release.

To make managing your business finances easier, we recommend creating separate PayPal, Zelle, Cash App or Venmo accounts just for your professional finances.”Continue article here.
